Introduction

An established practice

Zakir Hussain practises across public law, civil and commercial litigation, family proceedings, regulatory matters, criminal law and alternative dispute resolution. His instructions include advisory work, written advocacy, litigation, appeals, urgent applications and representation before courts and tribunals throughout England and Wales.

Before coming to the Bar, he served within the Home Office as an Immigration Officer. Since then he has acted for private clients, companies, public authorities, government departments and the Secretary of State. He understands how public bodies reach decisions, how those decisions are defended, and how they are properly challenged.

Suitable matters may be instructed directly under the Public Access scheme. Where appropriate, Zakir also conducts the litigation itself.

Criminal & Quasi-Criminal Proceedings

Proceedings involving personal liberty, reputation, regulatory enforcement and professional consequences, in the Magistrates' Court and the Crown Court. The practice includes road traffic proceedings, which frequently carry serious consequences for employment and professional standing.

Immigration, nationality, asylum and human rights law, including appeals, judicial review and complex public law challenges. A former career within the Home Office gives Zakir an unusually informed view of the decision-making he now contests and defends.

Government & Institutional Experience

Within and against the state

Zakir's background spans both sides of public decision-making. He has worked inside the Home Office, undertaken instructions from the Government Legal Department, and represented the Secretary of State in contested proceedings. He has also acted for those affected by government decisions.

The result is a practice that can assess a case from more than one vantage point. When instructed, his duty is to the administration of justice and to the client he has accepted responsibility to represent.

Every instruction is conducted personally. Zakir considers the papers, advises on the issues, settles the written work and appears where advocacy is required. Clients deal directly with the counsel responsible for the analysis, preparation and presentation of their case, from first advice to final hearing.

Advice

Clear advice from the outset. Advice determines the legal position, weighs the evidence, identifies the risks and sets the most effective course. Zakir advises directly. Where proceedings should be pursued, he advises how they should be prepared. Where a negotiated outcome or a different course would better protect the client's interests, he says so.

Effective advocacy is decided before the hearing. It requires command of the facts, disciplined analysis of the evidence and anticipation of the opposing case. Written and oral submissions are directed to the issues that matter and presented with a clear understanding of the result being sought.

Zakir is qualified to accept instructions directly from members of the public and businesses under the Public Access scheme, and is separately authorised to conduct litigation. In suitable cases this allows him to advise, prepare, correspond, manage proceedings and represent, without a solicitor first being retained.

Some matters remain better suited to a solicitor-led team. Suitability is assessed at the outset and the appropriate structure explained before an instruction is accepted.
